Any goods in possession of an insolvent estate that are subject to fixed charges or a proprietary right belong to the Legal owner and cannot be used by the liquidator to satisfy company debts. Critically analyse whether the reforms in the Enterprise Act 2002 go far enough in promoting a rescue culture by curtailing the rights of the Legal owner to claim their property on the event of insolvency, or is more reform needed?
